But IBAs are not ordinary contracts. Given the scope of their provisions and the extent of their impact, IBAs are quasi-legislative and better qualified as instruments of public law than private law. Public law is defined by its function of mediating the imbalance of power between the State and its citizens, but may also apply more broadly to quasi-public entities that exercise coercive powers or are entrusted with responsibilities of exceptional public importance. Transparency and public accountability are fundamental principles of public law, precisely because they attenuate legislative and quasi-legislative power. Given the monumental role of IBAs in Nunavut, their transparency in this context was arguably essential to maintaining public trust and integrity. On the basis of the annual monitoring and evaluation of the project`s performance, the commitments contained in the Annexes may be updated from year to year by agreement between the Parties to the IBA. The annexes are therefore dynamic working documents containing concrete and realistic commitments regarding the deployment of Greenland workers and companies. The licensee and subcontractors must comply with these obligations on an annual annual.
